This document establishes the general conditions governing the contractual relationship between the person (physical or legal), hereinafter "the Buyer" and the selling company Healthcare Marketing and Consulting, S.L., hereinafter "HCM&C"
The person who wishes to establish such a relationship with HCM&C through the e-commerce platform "YourTreatment.com" must register validly on that page, filling out an electronic form and providing personal data as appropriate. The privacy of this information is regulated in the section "Privacy Policy" annexed to this document.
Once the registration is completed and the user name and password obtained, the company will consider the person to be the Buyer, allowing the acquisition of the goods offered on the site "TuTratamiento.es".
1. Pre-Contracting Information
In compliance with the levels of transparency and clarity established by the legislation that applies to the e-commerce sector, HCM&C will not formalize any contract without the Buyer's knowledge of these General Conditions. To facilitate access and ensure contact with them by the Buyer, the selling company makes them available to any visitor to the site. Without prejudice to the foregoing, in order to validly register on the website, a formal declaration of knowledge and approval of this text will be required. Likewise, attached to the formalised offer of any product demanded by the Buyer will appear a link to this section together with the recommendation to read it.
2. Capacity
The Buyer registered on the website must, among other things, ensure that he or she is of legal age and has the legal capacity to establish business relations.
3. Purpose
The purpose of this contract is to regulate the legal business of buying and selling goods in which a natural or legal person acquires one or more goods offered by HCM&C through its electronic platform TuTratamiento.es, in exchange for a price established by the seller.
4. Obligations of HCM&C
4.1. In this contract, the company undertakes to deliver the products purchased by the Buyer to the address indicated by the Buyer within the period established. Any delay within this period caused by incomplete, insufficient or erroneous information will not be the responsibility of the company. The general delivery time for products is (**1 to 4 working days**). Without prejudice to the foregoing, the period may be extended by function of the availability of the product, a fact that will be clearly notified to the Buyer when placing the order.
4.2. The company is not responsible for any damage caused by misuse of the website. Likewise, it shall not be liable for any damage resulting from computer problems caused by third parties (viruses, spyware, malware...) on this platform or on Buyers' equipment. Notwithstanding the foregoing, HCM&C acts with the utmost diligence to avoid such inconveniences by protecting its systems with the technology most recommended for this type of threat.
4.3. HCM&C guarantees the highest quality in its products, as well as the perfect state of them at the time of delivery. If the Buyer detects any defect in the property purchased must notify the company as soon as possible, understanding as such a period of less than, in any case, 5 days. For the company to be responsible for any defects in the product purchased must be verified by technicians I) That the product is returned in its original packaging. II) That the product has not been used. III) That the damage has not been caused by misuse by the Buyer. IV) That the damage is exclusively the responsibility of society. The collection of the defective good will be made at the expense of the company, which, if possible, will replace the useless product with another in perfect condition. If, after detailed examination by HCM&C's technical service of the defective goods, the company considers that the Buyer was at fault for the deterioration of the product, it shall immediately notify the Buyer of this fact and shall exercise the remedies granted by law.
5. Obligations of the Buyer
The Buyer undertakes to pay the amount of the good purchased by the means and at the time it is established on the website, except typographical error.
The total amount includes, unless otherwise provided, the good purchased with VAT and shipping costs to the address indicated by the Buyer.
The Buyer is solely responsible for any damage suffered by the good after the time of delivery, which must verify the conformity of the product. The Company shall not be liable for loss, theft or damage occurring after the Buyer has been placed at its disposal.
6. Disclaimer of Liability
HCM&C commercializes numerous products, most of which belong to the health sector. Some of these products require for their correct operation certain guidelines of use that must be established by a doctor or health personnel. HCM&C does not intervene in the diagnosis, nor does it know all the pathologies that may affect the user of its products. The company only makes available to its customers what they demand, so it is not responsible for any misuse of its products or possible configuration errors that the uninformed Buyer may incur.
HCM&C will be able to guide the Buyer in the different options that the merchant offers, but this recommendation does not imply the absolute correction of the treatment.
7. Copyright and Trademark
The user (including Buyer) of this website acknowledges that all content is the intellectual property of HCM&C. The designs, disposition of products, photos, logos, formats, distinctives and marks belong to the company or to third parties, holding the exclusive right to use them in the commercial traffic. The diffusion of these contents, as well as the modification or reproduction constitute a violation of these rights. The company will not be liable for any actions that trademarks may take against users acting outside of this limitation. Notwithstanding the foregoing, HCM&C reserves the right to take any necessary legal action against those who infringe its intellectual property rights.
8. Applicable Law
This text has been drafted in compliance with the legal provisions affecting the commerce sector (especially electronic commerce) in force on 31 September 2010. The company will carry out the appropriate modifications in these conditions to adapt them to any alteration in the applicable regulations. Any such changes in the company's hiring policy will be notified on the website.
